Ohio Supreme Court Ruling, When a motorist is injured in an accident caused by avoiding an unidentified vehicle that fled the scene, evidence derived from the driver's account, such as a police report, can be used as "independent corroborative evidence" to support a claim for uninsured motorist insurance coverage.
Here is an example; The driver of the vehicle claims that another vehicle came into his lane of travel causing him to swerve to miss the other vehicle resulting in the said drivers car to crash into trees along the roadside.
The language called into question in the Uninsured Motorist Coverage is that there needs to be independent corroborative evidence to support a claim for uninsured motorist coverage for injuries. The police report is not in general considered as "independent corroborative evidence" so, there needs to be something more. Of course, if there was contact with the other vehicle and there is paint from the other vehicle that would be evidence. The reason for this rule is to prevent fraud when someone loses control of their vehicle and then claims to have been run off the road by a phantom vehicle that didn't stop in order to file an Uninsured Motorist Coverage claim as well as to avoid being charged with a traffic violation particularly if they were under the influence of alcohol or drugs and had someone pick them up at the crash site and then report the collision after they sobered up.
